The family of Lanie Kruszewski has filed a wrongful death lawsuit against the hit and run driver who struck her as she was riding her bicycle in Richmond’s West End.
On Tuesday, A Richmond judge sentenced the driver to three years in jail, which is the same sentence a jury had recommended at his trial in February. The jury found the driver guilty of leaving the scene of an accident that caused injury or death.
Kruszewski’s mother, Patty Kruszewski, is the administrator of her daughter’s estate.
The complaint states that Lanie Kurszewski was fatally struck while riding her bicycle on the night of July 29th. She was riding from her job as a server at Osaka Sushi & Steak to her boyfriend’s home in Richmond’s Fan District.
Kruszewski was riding her white bicycle with large, white headlights in front, flashing red lights in the rear and red reflectors, according to the complaint.
The driver, Elias Webb, 31, was traveling eastbound in his sport utility vehicle when it struck Kruszewski.
“Webb negligently, carelessly and recklessly operated his motor vehicle such that he caused his motor vehicle to collide with Lanie’s bicycle,” the complaint says.
According to the complaint, the collision caused Lanie’s body to be thrown onto the windshield of Webb’s SUV and then to the ground.
Lanie’s family is seeking $5 million, citing sorrow and mental anguish, among other effects, after Kruszewski’s death.
Webb testified at his trial that he thought he had struck a deer but that he turned himself in after he realized the next day that he had struck Kruszewski.
