There have been more than 100,000 complaints reported since 2000 when the Mirena contraceptive IUD received U.S. Food and Drug Administration (FDA) approval. These complaints range from Mirena migration to miscarriage to migraine headaches. There have been more than 900 Mirena lawsuits involving uterine perforation and/or spontaneous device migration and nine complaints involving neurological issues including migraine headaches.
Since there were only nine plaintiffs seeking to have their lawsuits centralized in Tennessee regarding their serious neurological conditions, their bid was rejected by the US Judicial Panel on Multidistrict Litigation since only nine suits did not warrant consolidation. However, Mirena uterine perforation lawsuits have been centralized.
As of August 17th, more than 900 lawsuits are underway in a multi-county litigation in New Jersey’s Bergen County Superior Court on behalf of women claiming Mirena migration has caused uterine perforations, organ damage and infertility. According to court records, there are hundreds more lawsuits with similar complaints filed and underway in a federal multidistrict litigation in US District Court, Southern District of New York.
It is more obvious to attribute uterine perforation to Mirena, which is why there have been so many lawsuits filed as a result. However, women suffering from neurological problems may not realize that Mirena could be the cause, which explains the mere nine lawsuits filed.
The Mirena prescribing information on the label does not mention neurological conditions, despite the fact that pseudotumor cerebri (PTC), also known as idiopathic intracranial hypertension (IIH), is linked to levonorgestrel. The Mirena is a levonorgestrel intrauterine device and contains 52 mg. of the progestin hormone. These neurological conditions occur by an increased build-up of cerebrospinal fluid on the brain, which causes increased pressure and migraine headaches. If PTC or IIH isn’t diagnosed in a timely manner, it can lead to permanent vision loss and even blindness.
