February 11, 2011 – New York, NY – Drug maker Johnson & Johnson has been sued by the state of Oregon for allegedly selling defective drugs. The lawsuit proposes that Johnson & Johnson, while knowing that some supplies of its Motrin brand drug were defective, continued to sell the drug in gas stations and convenience stores. According to a story from CNNmoney.com, the lawsuit also names 2 of Johnson & Johnson’s subsidiaries, McNeil PPC Inc. and McNeil Healthcare Inc., who are the makers of pain medications including Motrin, Tylenol and Benadryl. According to the suit filed by the state, Johnson & Johnson hired private contractors to secretly purchase the defective Motrin, in order to remove it from the market without notifying the general public or relevant government agencies about the issue.
Federal officials from the U.S. Food and Drug Administration (FDA) discovered this issue during a Congressional hearing in mid 2009; however, Johnson & Johnson did not announce its Motrin recall until February 2010. In December 2010, the CEO of Johnson & Johnson admitted that his company secretly engaged in the re-purchase of the defective Motrin products.
