An Illinois man is suing Novartis, the makers of the anticonvulsant drug Trileptal, after it led to his developing of Stevens-Johnson Syndrome, a rare but serious skin disorder. Of the ten claims Justin Roberson brought against Novartis, nine were dismissed by Senior Judge George W. Lindberg of the U.S. District Court for the Northern District of Illinois.
The U.S. Food and Drug Administration approved Trileptal to treat seizures, often to help people who suffer from bipolar disorders or neuropathic pains. They do not, however, approve of Trileptal use in people who are bipolar or have neuropathic pains. Using this medication for the unapproved treatments is considered “off label” use, which has led to many lawsuits.
The only claim Judge Lindberg acknowledged as sufficient was Roberson’s fraud claims. Roberson alleged Novartis misrepresented the safety and effectiveness of Trileptal.
