Elena Ivanova, 54, of New Jersey, was on her way home when she entered a subway station at Broadway and 86th Street. Her high-heeled shoe got caught in a gap, leading to her fall.
The gap was caused by a concrete step that had eroded, exposing the metal tread. Ivanova fell down 18 steps, resulting in cuts and bruises, along with a broken clavicle. She has undergone three surgeries and has suffered permanent injuries as a result.
Named in the lawsuit was the New York City Transit Authority. They were found liable due to a failure to maintain the subway station, making it unsafe.
Although the transit authority attempted to settle, the case ended up going to the New York State Supreme Court. The jury reached a verdict and awarded the plaintiff with $450,000 in damages. The bulk of the blame was placed on the transit authority and not on Ivanova. In fact, they were found to be 83% at fault.
