December 1, 2010 – Juneau County, WI – Necedah residents Peter and Heather Waltemath received a $6 million settlement in a medical malpractice lawsuit involving their son, Mason. According to an article from the Juneau County Star Times, Mason Waltemath allegedly suffered severe neurological injuries because of medical negligence during his delivery. Heather Waltemath gave birth to Mason on February 26, 2005 at Hess Memorial Hospital in Mauston. Because of alleged mistakes made by the hospital staff during the labor and delivery process, Mason Waltemath now suffers severe quadriplegic cerebral palsy and, according to the settlement document, “is totally dependent on others for all aspects of daily living and will be for his entire life.” The lawsuit was filed against Mile Bluff Clinic physician June Lewandowski, Heather Waltemath’s primary doctor, Hess Memorial Hospital and the Mile Bluff Clinic. The original suit sought unspecified damages. The final negotiated settlement totaled at $6 million. When he approved this settlement, Judge Paul Curran said there was no admission of wrongdoing or error by the caregivers noted in the settlement. The settlement has been divided to serve several purposes. $1,666,666 is to go to Jeffrey Goldberg, the Waltemath’s lawyer, for attorney’s fees and payment. A portion of the money will go to the Waltemaths immediately for the payment of other fees and medical bills. The rest, more than $4 million, is to be held in a trust for the care of Mason Waltemath.
