The New York Times reports that a civil trial against Merck, the maker of Fosamax, is currently underway. Judith Graves, 67, developed a condition known as “jawbone death” after taking the prescription drug that is meant to treat women with osteoporosis. Graves’ attorney shared with the jury the suffering that she has gone through with the deterioration of her jawbone. The deterioration was so bad that she has undergone 5 major surgeries. One particular surgery required the use of bone from her left arm to replace her broken jaw. Merck is denying that use of Fosamax caused her condition. Lawyers for the Merck argue that it was the use of other prescription drugs used to treat her rheumatoid arthritis which caused her immune system to weaken. They contend that her weakened immune system is what led to her jaw condition. This is just one lawsuit of approximately 1,400 others, in which victims claim that Fosamax is responsible for their jaw conditions. The lawsuit has also raised questions among doctors and researchers about the use of Fosamax to treat osteoporosis. Last month the FDA issued a warning that states there is not enough clarification on the safety of oral bisphosphonates and whether they can lead to bone fractures. It now requires oral bisphosphonates such as Fosamax to include a label which indicates that the optimal time period for use of the drug is unknown.
