December 1, 2010 – Jefferson County, TX – A medical malpractice claim has been filed in Texas against 3 healthcare providers regarding a hospice patient who died with untreated ulcers, The Southeast Texas Record has reported. Mary Helen Smith, 87, died about 2 years ago. The claim alleges that Smith was not treated for the painful ulcers in her final days. According the claim, “All of the conditions arose while she was under the care of defendants and was caused by the negligence of the employees of defendants … After suffering pain and the festering ulcers for which she received virtually no care, Smith died.” The medical malpractice claim was filed on November 16, 2010, by Patsy Monson. It was filed against Gulf Healthcare Center-Port Arthur, Southwest Gulf Healthcare and Harbor Hospice of Beaumont. The claim states that all 3 institutions failed to treat Smith’s condition. Court papers have evidence that Smith did in fact have multiple ulcers at the time of her death. This condition may have been avoided had any one of the named defendants taken appropriate preventive measures. Monson intends to sue for general and special damages. The defendants’ response to these allegations is unknown at this time.
