Supreme Court Reviews Barred Bayer Class Action Lawsuit

January 28, 2011 – Washington, D.C. – According reports from The Wall Street Journal, the U.S. Supreme Court has questioned a federal judge’s verdict to prevent a group of plaintiffs from suing Bayer over its former drug Baycol. Baycol, which was meant to reduce patients’ levels of cholesterol, has been the subject of much litigation over the past 10 years.  In the lawsuit, the West Virginia plaintiffs alleged that they paid for a drug that was inferior to other cholesterol-reducing drugs on the market. Baycol was taken off of the market in 2001 after being linked to 31 deaths. As a result of legal claims that followed Baycol’s withdrawal, Bayer paid nearly $1.2 billion to patients who allegedly suffered ill effects from the drug.  In this particular case, A U.S. district court judge has barred the West Virginia group from going forward with their class-action lawsuit.

The reason behind the decision was that the judge had already ruled that a previous group of West Virginia plaintiffs did not meet the standards for such a case.  Recently the U.S. Supreme Court spent an hour questioning this verdict but a final decision has not been reached in the matter.
